These Terms and Conditions (“Terms“) govern your access to and use of the VibeJe platform, including the VibeJe mobile application and website (collectively, the “Platform“). The Platform is owned and operated by OBSIDIAN GROUP SDN BHD a company registered under the laws of Malaysia (“VibeJe”, “we”, “us”, or “our”).
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Platform.
IMPORTANT NOTE: VibeJe is currently available only in selected areas of Malaysia: Sarawak, Kuala Lumpur, and Selangor. This geographical restriction will apply until December 31, 2025. Only users within these areas or willing to travel to these areas for events should use the Platform.
1. Eligibility and Age Gate
1.1 You must be at least eighteen (18) years of age to access or use the Platform and participate in VibeJe events.
1.2 By creating an account, you represent and warrant that you are 18 years of age or older.
1.3 We reserve the right to request proof of age and to suspend or terminate your account if we have reason to believe you do not meet the age requirement.
2. Account Registration and Responsibility
2.1 To use most features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during the registration process.
2.2 You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
2.3 You agree not to create more than one account.
3. User Types: Vibers and Hosts
3.1 Vibers: Individuals who use the Platform to discover and book activities (“Vibers”).
3.2 Hosts: Individuals, groups, or entities who use the Platform to create and organize activities (“Hosts”).
4. Viber Specific Terms
4.1 Activity Discovery and Matching: VibeJe uses a personality assessment and other information you provide to suggest activities and connect you with potentially compatible individuals. This is a suggestion service only, and we do not guarantee compatibility or successful connections.
4.2 Pricing Plans:

Free Plan: Pay RM 40 per event.

Monthly Subscription: RM 100/month for up to 10 events/month.

Quarterly Subscription: RM 200/3 months for unlimited events.

4.3 Payment: All payments are processed through a secure third-party payment gateway. You agree to provide valid payment information and authorize VibeJe and its payment processor to charge your payment method.
4.4 Booking and Membership Duration:

Subscription is valid from the purchase/renewal date.

You can book events only within your current subscription period.

Events outside your subscription period will require a RM 40 per-event fee.

4.5 Subscription Renewal: Subscriptions are typically auto-renewed. You can manage preferences in your account.
4.6 Cancellation Policy:

Cancel anytime through your account.

If no events are booked, cancellation is immediate and may be eligible for a refund (see Section 4.7).

If events are booked, cancellation is effective at the end of the subscription period.

4.7 14-Day Refund Policy: Cancel within 14 days without booking any events to be eligible for a full refund. Contact support at [email protected].
4.8 Event Cancellation by Host or VibeJe: If an event is canceled and you paid RM 40 or it counted towards your Monthly plan, you’ll receive a refund or booking credit. Quarterly plan users will simply be notified.
5. Host Specific Terms
5.1 Host Account: Hosts must register and agree to these Terms and additional Host Terms.
5.2 Activity Creation: Hosts may list events, providing accurate details. Activities must comply with the Community Guidelines (see Section 7).
5.3 Host Subscription Plans:

Plan 1: RM 200/month for up to 5 events. VibeJe guarantees at least 7 total participant bookings across 2 events.

Plan 2: RM 400/month for up to 10 events. VibeJe guarantees at least 7 total participant bookings across 4 events.

5.4 Payment: Subscription fees are processed monthly through the payment gateway.
5.5 Renewal and Cancellation: Auto-renewed by default. Cancellation takes effect at the end of the billing cycle. No refunds.
5.6 Guarantee Fulfillment: If the guaranteed bookings are not met, VibeJe will provide a 50% discount on the next billing cycle or an equivalent credit.
5.7 Host Responsibilities: Hosts are responsible for safety, compliance with laws, and accurate event descriptions.
5.8 Host Payouts: Hosts are not paid per participant. The subscription fee covers listing and guarantees. Hosts manage all event-related costs independently.
6. Content and Conduct
6.1 You are responsible for content you post. It must not infringe intellectual property or violate laws.

7. Community Guidelines
You agree to follow VibeJe’s Community Guidelines, which govern behavior on the Platform and at events.
8. Intellectual Property
8.1 All non-user content is the property of VibeJe or licensors.
8.2 You are granted a limited, non-exclusive license to use the Platform.
8.3 By posting content, you grant VibeJe a worldwide, non-exclusive, royalty-free license to use it for Platform operations and promotions.
9. Disclaimers
9.1 The Platform and activities are provided “as is” without warranties.
9.2 VibeJe does not endorse or guarantee any Host, activity, or user conduct.
9.3 No guarantee of Platform uptime or security.
10. Limitation of Liability
VibeJe is not liable for indirect or consequential damages, loss of data, profit, or other intangibles from use of or inability to use the Platform.
11. Indemnification
You agree to indemnify and hold harmless VibeJe, its employees, and agents from any claims or liabilities arising from your content or violation of these Terms.
12. Governing Law and Dispute Resolution
These Terms are governed by Malaysian law. Any dispute will be under the jurisdiction of Malaysian courts.
13. Termination
We may suspend or terminate accounts at our discretion for any violation or harm.
14. Changes to Terms
We may modify these Terms at any time. Material changes will be notified via Platform or email. Continued use indicates acceptance.
15. General Provisions
15.1 These Terms are the entire agreement between you and VibeJe.
15.2 If any provision is found unenforceable, the remainder stays in effect.
15.3 No waiver of rights by inaction.
15.4 You may not assign these Terms. VibeJe may do so without restriction.
