VibeJe Terms and Conditions

Welcome to VibeJe!
These Terms and Conditions (“Terms”) govern your access to and use of the VibeJe platform, including the VibeJe mobile application1 and website (collectively, the “Platform”). The Platform is owned and operated by [Your Company Name], a company registered under the laws of Malaysia (“VibeJe”, “we”, “us”, or “our”).
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Platform.
IMPORTANT NOTE: VibeJe is currently available only in selected areas of Malaysia: Sarawak, Kuala Lumpur, and Selangor. This geographical restriction will apply until December 31, 2025. Only users within these areas or willing to travel to these areas for events should use the Platform.
1. Eligibility and Age Gate
1.1 You must be at least eighteen (18) years of age to access or use the Platform and participate in VibeJe events.
1.2 By creating an account, you represent and warrant that you are 18 years of age or older.
1.3 We reserve the right to request proof of age and2 to suspend or terminate your account if we have reason to believe you do not3 meet the age requirement.
2. Account Registration and Responsibility
2.1 To use most features of the Platform,4 you must register for an account. You agree5 to provide accurate, current, and complete information during the registration process.
2.2 You are responsible for maintaining the confidentiality of your account password and are responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
2.3 You agree not to create more than one account.
3. User Types: Vibers and Hosts
3.1 Vibers: Individuals who use the Platform to discover and book activities (“Vibers”).
3.2 Hosts: Individuals, groups, or entities who use the Platform to create and organize activities (“Hosts”).
4. Viber Specific Terms
4.1 Activity Discovery and Matching: VibeJe uses a personality assessment and other information you provide to suggest activities and connect you with potentially compatible individuals within event groups. This is a suggestion service only, and we do not guarantee compatibility or successful connections.
4.2 Pricing Plans: As a Viber, you have the following options:
* Free Plan: You can book events by paying a per-event fee of Ringgit Malaysia Forty (RM 40) per event.
* Monthly Subscription (RM 100/month): Pay a monthly fee of RM 100 to book up to ten (10) events per month at no additional charge. This limit resets each month your subscription is active.
* Quarterly Subscription (RM 200/3 months): Pay a fee of RM 200 for unlimited event bookings for a period of three (3) consecutive months at no additional charge.
4.3 Payment: All payments are processed through a secure third-party payment gateway. You agree to provide valid payment information and authorize VibeJe and its payment processor to charge the applicable fees to your chosen payment method.
4.4 Booking and Membership Duration:
* Your subscription (Monthly or Quarterly) is valid for the specified duration from the date of purchase or renewal.
* You can only book events that are scheduled to occur within your current active membership duration.
* If you attempt to book an event scheduled outside of your current membership duration, you will be prompted to pay the RM 40 per-event fee, regardless of whether you hold a subscription plan.
4.5 Subscription Renewal: Monthly and Quarterly subscriptions are typically set to auto-renew. You can manage your subscription preferences in your account settings.
4.6 Cancellation Policy:
* You may cancel your subscription at any time through your account settings.
* If you have not made any event bookings within the current membership period (the current month for Monthly, the current 3-month period for Quarterly), your cancellation will take effect immediately, and you may be eligible for a refund as per the 14-day Refund Policy (Section 4.7).
* If you have made at least one event booking within the current membership period, your cancellation will take effect at the end of your current membership duration (end of the current month for Monthly, end of the current 3-month period for Quarterly). You will not be billed for subsequent periods until you re-subscribe. You will not receive a refund for the current membership period.
4.7 14-Day Refund Policy: If you cancel your subscription within fourteen (14) days of initiating or renewing your Monthly or Quarterly membership, and you have not made any event bookings within that period, you may be eligible for a full refund of the subscription fee paid for that period. To request a refund under this policy, please contact our support team at [Support Email Address]. Refunds are not available if you have made any bookings or if more than 14 days have passed since initiation or renewal.
4.8 Event Cancellation by Host or VibeJe: If a Host or VibeJe cancels an event you have booked, and you were a paying Viber for that specific event (RM 40 fee) or it counted towards your Monthly plan limit, we will generally offer a refund of the per-event fee or reinstate the booking credit/limit for Monthly plan users. For Quarterly unlimited plan users, the cancellation will simply be noted.
5. Host Specific Terms
5.1 Host Account: To become a Host, you must register for a Host account and agree to these specific Host Terms in addition to the general Terms.
5.2 Activity Creation: Hosts can create and list activities on the Platform, providing accurate and complete details. All activities must comply with VibeJe’s Community Guidelines (see Section 7).
5.3 Host Subscription Plans: As a Host, you have the following paid monthly subscription options:
* Plan 1 (RM 200/month): Pay a monthly fee of RM 200. This plan guarantees a minimum of [Clarify Host Guarantee – e.g., 7 total participant bookings across 2 events OR 7 participant bookings per event for 2 events] within the month. You can list a maximum of five (5) events per month under this plan.
* Plan 2 (RM 400/month): Pay a monthly fee of RM 400. This plan guarantees a minimum of [Clarify Host Guarantee – e.g., 7 total participant bookings across 4 events OR 7 participant bookings per event for 4 events] within the month. You can list a maximum of ten (10) events per month under this plan.
5.4 Payment: Host subscription fees are paid monthly through the secure payment gateway.
5.5 Subscription Renewal and Cancellation: Host subscriptions are typically set to auto-renew. You may cancel your Host subscription at any time, but the cancellation will take effect at the end of the current monthly billing cycle. No refunds will be provided for the current billing cycle.
5.6 Guarantee Fulfillment: The Host guarantees relate to a minimum number of participant bookings for a specified number of events within the month. VibeJe will track bookings for your listed events. If the guaranteed number of participant bookings is not met for the guaranteed events in a given month despite the events being listed and available, VibeJe will [Clearly state the compensation mechanism – e.g., provide a credit towards the next month’s subscription, offer a partial refund, extend the guarantee to the following month]. The specifics of the guarantee fulfillment will be detailed separately in the Host Agreement provided upon Host registration.
5.7 Host Responsibilities: Hosts are responsible for conducting the activities safely and as described in the listing. Hosts must comply with all applicable laws and regulations related to their activities. VibeJe is not responsible for the conduct of Hosts or the safety or quality of activities.
5.8 Host Payouts: VibeJe does not handle direct payouts to Hosts for participant fees. The Host subscription fee covers the ability to list events and the booking guarantees provided by VibeJe. Hosts are responsible for any costs associated with their activities (e.g., venue fees, materials).
6. Content and Conduct
6.1 You are responsible for all content you post, upload, or otherwise make available on the Platform (“User Content”). You agree that your User Content will not violate any third-party6 rights, including intellectual property or privacy rights, or violate any applicable laws.
6.2 You agree not to use the Platform for any unlawful or prohibited activities, including but not limited to:
* Posting or transmitting any content that is defamatory, obscene, offensive, or harmful.
* Engaging in harassment, discrimination, or any form of unwelcome conduct.
* Promoting illegal activities or violence.
* Attempting to defraud or mislead other users.
* Distributing spam or unsolicited messages.
* Attempting to gain unauthorized access to the Platform or other users’ accounts.
* Any activity that violates Malaysian law.
7. Community Guidelines
7.1 You agree to abide by VibeJe’s Community Guidelines, which are incorporated by reference into these Terms. The Community Guidelines outline expected behavior on the Platform and during events to ensure a positive and safe environment for all users. 8. Intellectual Property
8.1 All content on the Platform, excluding User Content, such as text, graphics, logos, icons, images, audio clips, digital downloads, and software, is the property of VibeJe or its licensors7 and is protected by Malaysian and international copyright and intellectual property laws.
8.2 VibeJe grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal, non-commercial use, subject to these Terms.
8.3 You retain ownership of your User Content, but by posting it on the Platform, you grant VibeJe a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, display, and perform your User Content in connection with the Platform’s operation8 and promotion.
9. Disclaimers
9.1 The Platform and the activities9 listed on the Platform are provided “as is” and “as available” without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
9.2 VibeJe does not endorse any Host or activity and is not responsible for the quality, safety, or legality of any activity or the conduct of any Host or Viber.
9.3 VibeJe does not guarantee that the Platform will be error-free, uninterrupted, or secure.
10. Limitation of Liability
10.1 To the fullest10 extent permitted by Malaysian law, VibeJe shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting11 from (a) your access to or use of or inability to access or use the Platform;12 (b) any conduct or content of any third party on the Platform, including without limitation, any defamatory, offensive, or illegal conduct of other users or third parties; or (c) unauthorized access, use, or alteration of your transmissions or content.
11.13 Indemnification
11.1 You agree to indemnify, defend, and hold harmless14 VibeJe, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) that such parties may15 incur as a result of or arising from your User Content or your violation of these Terms or any applicable Malaysian law.
12. Governing Law and Dispute Resolution
12.116 These Terms shall be governed by and construed in accordance with the laws of Malaysia.
12.2 Any dispute, controversy, or claim arising out of or relating to these Terms or the Platform shall17 be subject to the exclusive jurisdiction of the courts of Malaysia.
13. Termination
13.1 We may suspend or terminate your account or access to the Platform at any time, for any reason, without notice, including if you violate these Terms or engage in conduct that we deem harmful to the Platform or other users.
13.2 Upon termination, your right to use the Platform will immediately cease.
14. Changes to Terms
14.1 We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the Platform or by email. By continuing to use the Platform after the changes become effective, you agree to be bound by the revised Terms.
15. General Provisions
15.1 These18 Terms constitute the entire agreement between you and VibeJe regarding the use of the Platform.
15.2 If any provision of these Terms19 is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
15.3 Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
15.4 You may not assign or transfer your rights or obligations under these Terms without our prior written consent. VibeJe may assign its rights and obligations without restriction.
